Per VARIETY, THE PENGUIN will now be branded as an HBO Original.  According to the trade, it’s part of a plan to rebrand their highest-profile titles under the HBO Originals banner and give them a linear airing on the premium cable network and their streamer, MAX.

Apparently, some legal/contractual issues have now been resolved, allowing THE PENGUIN to have the HBO brand.
